In this article, we argue against the point of view that affirms that sexual difference determines the gender of people. Specifically, the points of view of Agustín Laje and Nicolás Márquez are counter-argued. It is shown that his claims that the biological sciences support his views are erroneous and contain fallacies. Considerations about science and the biological sciences reveal that gender studies and feminist theories are not contradictory with the natural sciences, what allows them to be compatible research areas among themselves. Secondly, brief comments are presented, from ethics and political philosophy, on the errors and danger of biological positions in the formulation of moral and political norms. The results are that Laje and Márquez do not observe the epistemological complexity in which the biological sciences develop and that moral and political norms are formulated, firstly, around values and moral principles.
